RENTAL AGREEMENT TERMS & CONDITIONS

1. Careful Use and Compliance: The Lessee (renter) agrees to utilize the equipment responsibly, adhering to all applicable laws, regulations, rules, or ordinances. The Lessee further undertakes not to loan, sublet, mortgage, or alter the equipment without the prior written consent of the Lessor.

2. Rental Period and Responsibilities: The Rental Period begins upon the equipment leaving the Lessor’s premises and continues until its return unless mutually agreed upon in writing. The Lessee is responsible for daily, weekly, and monthly rental charges. Any partial day period is billed as a full day. Only suitably qualified individuals are authorized to operate the equipment. The lessee bears the costs of transportation and installation.

3. Equipment Condition and Maintenance: The Lessee agrees to return the equipment in the same condition, excluding normal wear and tear. The Lessee is responsible for all damage, repairs, and maintenance during possession. Lessee shall handle routine maintenance tasks and take care of everyday equipment needs. In case of equipment disablement, the Lessor is not liable for substitute equipment and any resulting special or consequential damages.

4. Equipment Alterations and Display: Lessee shall not remove, alter, disfigure, or cover any numbering, lettering, or insignia on the equipment. The equipment must not be installed in a way that suggests attachment to real estate or as a permanent fixture on titled equipment.

5. Title and Liability: The title to the equipment remains with the Lessor. Lessee must notify Lessor immediately if the equipment faces levies, claims, or threats of seizure. Lessee indemnifies and holds Lessor harmless from all liability and expenses arising from the possession or use of the equipment.

6. Insurance and Loss/Damage Responsibility: The Lessee must provide liability insurance against physical loss or damage. Lessee is responsible for bearing all risks of loss or damage to the equipment and must have insurance. Lessee agrees to pay in cash for the total value of lost or destroyed equipment or the cost of repairs determined by the Lessor.

7. Lessee’s Insurance Obligations: Lessee shall provide and maintain liability insurance and insurance against physical loss or damage at its own expense. Certificates of insurance must be provided to Lessor, naming Lessor as an insured party. Failure to provide insurance does not relieve Lessee of responsibilities under this Agreement.

8. Lessor’s Inspection Rights and Termination: Lessor has the right to inspect the equipment and may terminate the agreement if Lessee fails to pay rent, commits an act of bankruptcy, or breaches the agreement.

9. Payment Terms: Terms are NET 30 days from the invoice date. Invoices are issued upon the return of the equipment or monthly for multiple-term rentals. A service charge of 18% applies to delinquent accounts overdue 30 days.

10. Credit Card Payments: Credit card customers must complete an authorization form before rental commencement. Rental charges are billed at the start, and credits or additional charges are applied upon completion. A 3% processing fee applies to all credit card transactions.

11. Costs and Expenses: Lessee agrees to pay all costs incurred by Lessor, including attorney’s fees in exercising its rights or enforcing the terms and conditions of this agreement.

12. Warranty Disclaimer: The Lessor makes no express or implied warranties of merchantability or fitness for a particular purpose regarding the rented equipment.

13. No Oral Agreements: No oral promises, terms, conditions, or warranties, express or implied, are valid, except those in writing within this Agreement.

14. Lessor’s Liability Limitation: Lessor’s liability under this Agreement is limited to the total rental charges paid by Lessee.

15. Export Control Compliance: Lessee acknowledges responsibility for compliance with U.S. export control laws. The Lessee must obtain the required licenses for the equipment’s export, reexport, or return.16. Venue and Jurisdiction: Venue and jurisdiction for disputes lie in the courts of Hillsborough County, Florida.
